2Use of the Website

• notifying VORAST or their organisation's administrator if they believe their account has been compromised.

Activity performed through a user account may be recorded within VORAST audit logs.

4Customer Organisations

Where access to VORAST is provided by an employer, client or other organisation, that organisation may control:

• user access;
• roles and permissions;
• information entered into the platform;
• configuration of available functions;
• retention of operational records; and
• decisions made using information displayed within VORAST.

Users must also comply with any internal policies, procedures or instructions issued by the organisation providing their access.

5Operational Information

VORAST is designed to support operational management and decision-making.

The platform may display information relating to:

• staffing;
• competence;
• training;
• attendance;
• operational readiness;
• assets;
• inspections;
• compliance;
• certification;
• alerts; and
• other business or operational information.

Users remain responsible for verifying critical information before relying on it for operational, safety or management decisions.

6Operational Alerts and Decision Support

VORAST may generate automatic:

• alerts;
• warnings;
• notifications;
• status indicators;
• compliance flags;
• readiness indicators; and
• recommendations for review.

These functions are intended to support authorised personnel.

They do not replace the professional judgement, legal responsibility or operational authority of appropriately qualified managers, supervisors, competent persons or other authorised personnel.

Where VORAST identifies a possible issue, the relevant organisation remains responsible for determining and implementing the appropriate response.

7Emergency and Safety-Critical Use

Unless specifically agreed in writing, VORAST is not intended to replace:

• emergency communications systems;
• alarm systems;
• emergency dispatch systems;
• statutory safety systems;
• emergency response procedures; or
• direct operational command and control.

Users must follow their organisation's approved emergency procedures and safety systems.

VORAST should not be treated as the sole source of information where failure or delay could create an immediate risk to life, safety, property or the environment.

8Accuracy of Information

VORAST relies partly on information entered or supplied by users, customers and third parties.

We take reasonable steps to provide accurate and reliable services, but we cannot guarantee that all information will always be:

• complete;
• accurate;
• current;
• error-free; or
• suitable for every operational purpose.

Users and customer organisations are responsible for reviewing and maintaining information entered into their accounts.

9Availability of the Service

We aim to provide reliable access to VORAST but do not guarantee that the website or platform will always be available without interruption.

Access may occasionally be restricted due to:

• planned maintenance;
• emergency maintenance;
• software updates;
• infrastructure failures;
• internet or communications failures;
• cybersecurity incidents;
• circumstances outside our reasonable control.

Where commercially appropriate, service availability commitments may be defined separately within customer agreements or Service Level Agreements.

10Intellectual Property

Unless otherwise stated, all intellectual property relating to VORAST is owned by or licensed to VORAST.

This includes:

• software;
• source code;
• platform design;
• website content;
• graphics;
• logos;
• trademarks;
• databases;
• reports;
• templates;
• workflows;
• documentation; and
• underlying technology.

Use of VORAST does not transfer ownership of any intellectual property to the user or customer.

You may not reproduce, modify, reverse engineer, distribute, sell, license or exploit VORAST intellectual property without prior written permission.

11Customer Data

Customers retain their rights in information and records uploaded to or created within their VORAST environment, subject to the relevant customer agreement.

Customers are responsible for ensuring that they have appropriate authority to upload and process information through VORAST.

VORAST may process customer data only to the extent reasonably necessary to:

• provide the service;
• maintain system security;
• provide support;
• comply with legal obligations; and
• perform other activities authorised by the customer agreement.

12Confidentiality

Users must not disclose confidential information obtained through VORAST unless authorised to do so.

Confidential information may include:

• employee records;
• customer information;
• operational information;
• site information;
• commercial information;
• security information;
• asset records;
• compliance information; and
• internal reports.

Users must handle information in accordance with their organisation's access permissions and confidentiality requirements.

13Third-Party Services

VORAST may integrate with or contain links to third-party services.

Third-party services are governed by their own terms and privacy policies.

VORAST is not responsible for the availability, content, security or operation of third-party services that are outside our control.

14Privacy and Personal Data

Use of VORAST may involve the processing of personal information.

Personal information will be handled in accordance with the VORAST Privacy Policy and applicable data protection requirements.

Users must not upload personal information into VORAST unless they are authorised to do so.

15Suspension or Termination

VORAST may suspend or terminate access where reasonably necessary, including where:

• these Terms are breached;
• a user creates a security risk;
• unauthorised activity is suspected;
• payment obligations under a commercial agreement are not met;
• access is requested to be removed by the customer organisation;
• continued access would breach legal or regulatory requirements.

Termination of access does not automatically remove obligations relating to confidentiality, intellectual property or outstanding contractual responsibilities.

16Limitation of Liability

To the maximum extent permitted by applicable law, VORAST will not be responsible for indirect, incidental or consequential loss arising from use of the website or services.

This may include loss of:

• profit;
• revenue;
• business;
• opportunity;
• anticipated savings; or
• data.

VORAST will not be responsible for losses resulting from:

• incorrect information entered by a customer or user;
• failure to follow operational procedures;
• unauthorised account access caused by a user's failure to secure credentials;
• third-party systems or services;
• internet or communications failures; or
• circumstances outside VORAST's reasonable control.

Any specific financial liability between VORAST and a customer will be governed by the applicable commercial agreement.

Nothing in these Terms excludes liability that cannot legally be excluded.

17Indemnity

Where permitted by law, users and customer organisations are responsible for losses, claims or liabilities resulting from unlawful or unauthorised use of VORAST or from information uploaded in breach of applicable law or third-party rights.

18Changes to the Service

VORAST may develop, modify or improve its website and platform over time.

This may include:

• new features;
• revised workflows;
• changes to interfaces;
• security improvements;
• technical changes; and
• removal or replacement of existing functionality.

We may make changes where reasonably necessary to improve the service, maintain security or comply with legal requirements.

19Changes to These Terms

We may update these Terms of Use periodically.

The latest version will be published on the VORAST website with the effective date shown at the top.

Continued use of the website or services after updated terms take effect will constitute acceptance of the revised terms, where permitted by applicable law.

Material contractual changes affecting paying customers may also be dealt with through the relevant customer agreement.

20Governing Law

Unless otherwise agreed in writing with a customer, these Terms will be governed by the laws of:

Any dispute will be subject to the jurisdiction of the courts specified within the applicable customer agreement or, where no separate agreement exists, the courts of the jurisdiction stated above.
